Outline of the Privacy Policy:

  • Sports Concussion Australasia ™ Pty Ltd (ABN 93155451317) governs how the HeadSmartTMSports Concussion Programme (HSCP) and any of its affiliates (collectively, “HSCP”) collect, store, retain, use and share information obtained from users in connection with the HeadSmartTM Sports Concussion Programme (“Programme”). This includes information collected via the website at www.headsmart.me (“Site”), via software applications for use on smart phones, tablets or computers (“Applications”), via other products provided in connection with the Programme (“Products”), and via concussion tools made available through the Programme (“Tools”).
  • In addition, if you register for or take the CogState Sports Concussion Test ("CCAT") available on the Site and/or Applications, your User Information may also be shared with and stored, retained, used and shared by Axon Sports, LLC (“Axon Sports”) in accordance with CogState Sport’s Privacy Policy located at cogstate.com/website-privacy-policy.  Users must also purchase a  voucher to take the CogState test.
  • This Privacy Policy applies to any and all users of the Site, Applications, Products or Tools (collectively, “Services”), including:
    1. an individual adult, a person under 18 years of age (“Child”), or a Child under 13 years of age (“Young Child”);
    2. a parent or legal guardian registering for or using the Services on behalf of a Child (“Parent/Guardian”) or a person acting on behalf of and with the authority of a Parent/Guardian (“Authorised Agent”);
    3. an organisation, such as a school, sporting organisation or medical provider, which uses the Services or purchases CCAT vouchers for distribution to individuals or registers for the Services on behalf of a Child with the consent of his/her Parent/Guardian (“Institutional Users”).

Right to change the Policy:

  • The HSCP reserves the right, in its sole and absolute discretion, to amend this Policy from time-to-time. In the event such an amendment constitutes a "material" change (as defined below) in the collection and/or aggregation of Personally Identifiable Information or Other Personal Information, HSCP will notify you in advance of such proposed change and will provide you with an ability to "opt-out" of your registration and use of the Services.
  • For purposes of this Policy, "material" means a change which expands the HSCP’s ability to collect, use or disclose Personally Identifiable Information and/or Other Personal Information.
  • If, following notice from HSCP regarding an adoption of a material change, you continue to use the Services, such continued use will constitute your acceptance of such material change(s). If you decide that any of the material changes are not acceptable to you then you should immediately stop using the Services.

Privacy of Information:

  • Registering for the Programme and/or using certain features of the Site, Applications,Products or Tools (such as purchasing CogState test credits or vouchers, or registering for and taking the CCAT) will require individual Users to submit personal information about the User and/or any minor represented by the User (“User Information”). By providing such User Information, the User grants to HSCP a worldwide, perpetual, sub-licensee, royalty-free license to store, retain, use and share the User Information, subject to the HSCP’s Privacy Policy.In the event of an inconsistency between these Terms and HSCP’s Privacy Policy, these Terms shall prevail.
  • In addition, by registering for or taking the CogState test, you agree that the User Information that you provide may also be stored, retained, used and shared by Axon Sport, subject to Axon Sport's Privacy Policy located at cogstate.com/website-privacy-policy. In the event of an inconsistency between these Terms and Axon Sport's Privacy Policy, these Terms shall prevail.

Sponsorship Policy:

The HeadSmartTM Sports Concussion Programme (HSCP) does offer advertising opportunities on a case by case assessment basis. The are no current sponsors or advertisers. The Partners and the SCP mutually agree to share backlinks & logo to assist with Search Engine Optimization (SEO). Any income that may be generated from advertising would be re-invested to maintain viability of the programme. The aim is to make concussion management tools freely available to all parents, coaches, athletes and others. Commercial viability (maintenance and running costs etc) of the programme at this stage is provided by the director at this stage.  In the long-term, viability would unlikely to be possible without some form of sponsorship. None of the content on the website is influenced by any partnership or funding source. All statements are scientifically valid and reference based. Referenced superscripts were removed after a trial period in the content of the web pages (cf journal article style) as it cluttered the page and gave the impression of only being applicable to medical persons. A separate References page in the footer serves to validate the content. The editorial content on the website is not influenced by the funding  sources and never will be. Our website hosts Google sponsored ads and links. We do not control the Google ads content. All banners and logos that represent our Partners, as described above - have been framed and labelled with the caption "Advertisement". Advertisements for sporting headgear and mouthguards promoted to reduce the severity and incidence of concussion will NOT be accepted as science does not support this claim. The HSCP displays advertisements and banners and no advertorials.

Sponsorship Guidelines & Provisions:

The choice of sponsorship category is valid for 1 year only. The choice of sponsorship category containing the provision of advertising options serves as a guideline, further tailoring of the category is negotiable. Sponsorship is payable in advance for 1 year prior to the features being implemented. A renewal notice shall be sent 1 month prior to the completion of the 1 year sponsorship period. The sponsorship is non-refundable. An analytics report shall be supplied bi-annually. The Sponsor should provide a high definition vector and JPEG logo for print purposes and a clear lower resolution vector and JPEG logo for the website. Where opportunities present themselves, the option of print media promotions will be offered to the sponsor. All sponsor advertising / marketing releases will be sent to the sponsor prior to publication for sponsor approval and signature. These Terms and the rights, obligations, liabilities, and responsibilities of the parties hereto, shall be governed and interpreted in accordance with the laws of the Commonwealth of Australia, without reference to the conflicts of laws principles of that or any other jurisdiction. The invalidity of any provision of these Terms by any court having competent jurisdiction shall not affect the validity of the remaining provisions of these Terms which shall remain in full force and effect. The waiver by HSCP of any default or breach of these Terms will not constitute a waiver of any other or subsequent default or breach. No act, delay or omission on the part of HSCP will be deemed a waiver unless expressly made in writing.

Advertising Policy and Potential Conflict of Interest:

An admin fee  is charged to cover the CPD accreditation fee as dictated by Australian Medical Council. The cost of the CogState test goes directly to CogState Sports.
